Please read these Terms of Service ("Terms") carefully. By accessing or using the Service you agree to be bound by these Terms.

1 Definitions

• Company – "MiaDoll Ltd." and its affiliates.
• Service – the Company's crypto-only hosting and messaging platform (web + mobile).
• User – any individual or entity using the Service.
• Creator – a User who uploads or streams Content.
• Content – all text, images, audio, video or other media uploaded or streamed by Creators.
• Dashboard – the private interface where Users and Creators view prices, fees and payouts.
• Cryptocurrency – any digital asset supported by the Service for payments.
• Pre-Landing Page – go.miadoll.com, where paid traffic is routed for age-gate and Terms acceptance.
• Affiliate – any party driving traffic through approved networks.
• Takedown Notice – a notice compliant with DMCA (U.S.) or DSA Art. 16 (UK/EU).
• KYC Provider – any third-party vendor approved by the Company to issue zero-knowledge age tokens.

2 Legal Status

The Service is a neutral hosting provider only. All Content is supplied by independent Creators. The Company is not a "producer" under 18 U.S.C. § 2257. 2257 Exemption. Content may contain artistic or soft-erotic nudity but no "sexually explicit conduct" as defined in 18 U.S.C. § 2256; therefore § 2257 record-keeping obligations do not apply.

3 Eligibility & Age-Gate

1. Users must confirm they are 18 years or older (or legal age in their jurisdiction) and never under 13.
2. All paid advertising traffic must first pass through the Pre-Landing Page, where Users tick "I am 18+ and accept the Terms".
3. The Company may request proof of age. Failure to provide may result in suspension or ban.

4 Payments

1. All payments are processed in Cryptocurrency via NOWPayments (nowpayments.io).
2. Current prices, platform fees and payout cadence appear in the Dashboard and may change unilaterally; continued use constitutes acceptance.
3. Blockchain transfers are final and irreversible. The Company does not custody private keys. Network fees and risk holds may apply.

5 Content Rules

Allowed: artistic or soft-adult nudity (top-less, lingerie, suggestive poses).

Prohibited (non-exhaustive): explicit sexual activity; minors; violence; bestiality; non-consensual acts; hate speech; doxxing.

Violations result in immediate removal; three strikes lead to permanent ban.

6 Safe-Harbor & Notice-and-Action

1. Valid Takedown Notice → removal or disablement within 24 h.
2. Repeat infringers are permanently banned.
3. Process complies with DMCA (U.S.) and DSA Art. 16 (UK/EU).

7 Disclaimers & Limitation of Liability

The Service is provided "as is, as available". No warranties, express or implied. To the fullest extent permitted by law, the Company is not liable for user Content, cryptocurrency volatility, lost profits, or indirect, consequential, or punitive damages.

8 Modifications

The Company may amend these Terms at any time by posting updates on the website and Pre-Landing Page. Material changes are effective upon posting; continued use constitutes acceptance.

9 Governing Law & Dispute Resolution

These Terms are governed by the laws of England & Wales. Disputes first go to confidential mediation; if unresolved within 30 days, they are finally settled by arbitration under the LCIA Rules in London.

10 Severability & Waiver

If any provision is unenforceable, the remainder remains in force. Failure to enforce any right is not a waiver.

11 Force Majeure

Neither party is liable for delays caused by events beyond reasonable control, including blockchain outages, cyber-attacks or government actions.

12 Account Security & Prohibited Uses

Users must safeguard private keys, passwords and Dashboard credentials. Prohibited activities include reverse-engineering, DDoS, spam, phishing, malware distribution, or any unlawful use.

13 Service Availability

No guarantee of uninterrupted or error-free operation; the Service may be unavailable without notice.

14 Financial & Tax Disclaimer

The Company is not a financial or tax advisor. Users are responsible for their own tax compliance.

15 Affiliate Traffic

1. Affiliates may promote the Service only through approved networks and must direct traffic to the Pre-Landing Page.
2. Incentivised, pop-up, PPV or malware traffic is prohibited.
3. Affiliate cookie duration: 30 days; postbacks are managed in the Dashboard.
4. Violations result in immediate termination and forfeiture of unpaid revenue.

Essential session cookies inside the app. Affiliate cookies (30 days) on the Pre-Landing Page for conversion tracking. Blocking cookies may affect functionality.

Data is retained only as necessary, but no less than five (5) years from account deletion or as required by law. Age-tokens and basic profile data are archived in encrypted form.

9 Security

TLS 1.3 in transit; AES-256 (HSM keys) at rest. Role-based access and regular audits. Breach notification within 72 hours where required.

10 International Transfers

Data may be processed in the UK, EU or elsewhere. Transfers outside the UK/EU rely on Standard Contractual Clauses or adequacy decisions.

11 Children

The Service is not directed to anyone under 13. We do not knowingly collect such data; if discovered, it is promptly deleted.

12 Updates

We may update this Policy at any time by posting a revised version with a new effective date. Continued use constitutes acceptance.
